Guide to Application for Registration of Trademark in China
Request of files & materials:
1. Registration form
point out name and address of applicant, and international classification &
catalog of the merchandise/service using the trademark.
2. A power of attorney (with signature)
3. 15 copies of trademark drafts; additional 2 copies of black & white trademark
drafts for colored trademark; request of size of draft is: 5′5(cm)10′10(cm);
4. If the trademark would be applied to medicine, foods for infant, or nurture
for medicine, applicant should provide the license to produce or sell from national
administration.;
5. If the trademark were portrait, applicant should provide the license to use,
which is signed by portrait holder and notarized.
6. The applicant who resides out of borders, shall provide his/its name and
address in Chinese.
7. The applicant who resides within borders, shall provide the copy of business
license sealed by Business Office in its registry place.
Note: Each application shall be filed according to one catalog, for the NICE
International Classification is adopted in China.
Right of Priority
1.Claim right of priority together with the application filing.
2.The certification of priority right shall indicate application date and application
No, and shall be certificated by the related department of state where this
trademark was applied firstly.
3.The certification of priority right may be submitted within 3 months after
application filing.
Renewal of Trademark
1.A power of attorney, with endorsed or signed;
2.The original certification of trademark registration;
3.10 copies of trademark drafts;
note: Renewal of trademark shall be applied within 6 months before the validity
of this trademark registration expires.
Application for Assignment of Registered Trademark
1.A power of attorney, with endorsed by transferee;
2.Request of registered trademark transfer, endorsed by both transferor and
transferee.;
3.The duplication of certification of registered trademark;
4.The transferee, who resides within border, shall provide the duplication of
business license sealed by Business Office in its registry place.
Putting the Contract of Trademark Using on Record

Application for Reissue of Certification of Trademark Registration

Application for Opposition
1.A power of attorney, endorsed or signed;
Note: Anyone can put forward his opposition to the trademark, which has passed
preliminary examination, within 3 months after the publication date of this
trademark.
Application for Adjudication on Disputed Registration Trademark
1.A power of attorney, endorsed or signed
Note: The earlier obligee can apply to Trademark Examination Committee for
dispute judging within 1 year from approving date of the trademark registration,
if the registered trademark is involved in dispute.
Application for withdraw of improper trademark registration

Application for reexamination

Note: The one who refuse to trademark office’s reject to registration application,
renewal application, and transfer application, or refuse to trademark office’s
dispute judging and withdraw judging, can apply to Trademark Examination Committee
for reexamination, and the file of reexamination application shall be submitted
within 15 days after receiving the reject or judging. The said time limit can
be extended once, and up to 30 days.
Guide to Application for International Registration of Trademark
Trademark international registration, also called Trademark International Registration
under Madrid Treaty, is one of the two ways to apply for trademark international
registration. The other way is to apply for trademark registration state-by-state.
Contrast to the state-by-state way, the way to apply for trademark international
registration under Madrid Treaty is considered more convenient. According to
the Madrid Treaty and related protocol, applicant can apply for trademark registration
to all of contracting states simultaneously. Now, the number of the contracting
states is 74.
You shall offer some material as below for trademark international registration:
1. Duplication of Certificate of trademark registration or receipt notice for
registration application in China;
2. 2 copies of trademark draft, and if the trademark is colored, 2 copies of
colored trademark draft is needed.
