

1. Action for infringement of patent
    Where a dispute arise as a result of the exploitation of a patent without the authorization of the patentee, that is, the infringement of the patent right of the patentee, the patentee or any interested party may institute legal proceedings in the people’s court. Where the infringement relates to a patent for utility model, the people’s court may ask the patentee to furnish a search report made by the Patent Administration Department under the State Council.
2. Action for dispute on ownership of a patent/patent application right
    Where a dispute arises as a ownership of a patent or patent application right, any interested party may institute legal proceedings in the people’s court.
3. administrative suit for patent right
    Where the patentee or the person who made the request for invalidation is not satisfied with the decision of the Patent Reexamination Board declaring the patent right invalid or upholding the patent right, such party may institute legal proceedings in the people’s court.
    Where an applicant for patent is not satisfied with the decision of Patent Reexamination Board, he or it may institute legal proceedings in the people’s court.
4. Action for dispute on patent/trademark contract
    Where a dispute arises as a contract for patent right or patent application right assignation, any interested party may institute legal proceedings in the people’s court.
5. Action for dispute on reward/remuneration to the inventor/creator of service invention-creation
    Where a dispute arises as reward or remuneration to the inventor or creator of service invention-creation, which has been applied for patent, the said inventor or creator, or the entity the service invention-creation belongs to, may institute legal proceedings in people’s court.
6. Action for dispute on inventorship/creatorship
    Where a dispute arises as a inventorship or creatorship, any interested party may institute legal proceedings in people’s court.
